Terms of Use

1. Agreement to these terms

These Terms of Use ("Terms") form an agreement between you and Antonio Netto, doing business as Nutrx ("Nutrx", "we", "us"), governing your use of the Nutrx iOS app and related services (the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. If you are under 18, you may use the Service only with the involvement of a parent or guardian.

3. License to use the app

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms and the App Store Terms of Service.

4. Not medical advice

Nutrx provides nutrition information and estimates for general wellness. It is not a medical device and does not provide medical advice. We do not diagnose, treat, cure, or prevent any condition, and we do not guarantee any particular health outcome. Always consult a qualified healthcare professional before making medical or significant dietary decisions. In an emergency, contact your local emergency services.

5. AI features and accuracy

Food recognition, macro estimates, and nutrition targets are produced by automated systems and may be inaccurate, incomplete, or unsuitable for your circumstances. Review and verify results before relying on them. You are responsible for the accuracy of the information you enter.

6. Your content and data

You keep ownership of the content you create in the app (such as your meals and notes). You grant us the permissions needed to process that content to provide the Service — including sending meal content you submit to our AI provider to generate your results, as described in our Privacy Policy.

7. Subscriptions and payments

• Some features require a paid, auto-renewing subscription, billed to your Apple ID.
• Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Manage or cancel anytime in your App Store account settings.
• Pricing and any changes are handled through the App Store in accordance with Apple's rules.
• Refunds are handled by Apple under the App Store's policies. We use RevenueCat to manage subscription status.

8. Acceptable use

You agree not to misuse the Service, including by attempting to reverse engineer, disrupt, or gain unauthorized access to it, using it unlawfully, or infringing others' rights.

9. Intellectual property

The Service, including the Nutrx name, logos, and software, is owned by Nutrx and protected by applicable laws. These Terms do not grant you any rights to our trademarks or branding.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or accurate.

11. Limitation of liability

To the fullest extent permitted by law, Nutrx will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us for the Service in the 12 months before the claim.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination will survive.

13. Changes to these terms

We may update these Terms from time to time. We will post the updated Terms here and revise the date above. Your continued use of the Service after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the Federative Republic of Brazil, without regard to its conflict-of-laws rules. You agree that the competent courts of the State of Minas Gerais, Brazil, will have jurisdiction to resolve any dispute arising from these Terms, except where mandatory local consumer-protection laws (such as the Brazilian Consumer Protection Code) give you the right to bring proceedings in your own place of residence.
